I had a client who I knew was a little bit flippant and a judge who was not very forgiving, and I told him not to say anything. At sentencing, the judge indicated that he was going to give my client six months in jail. My client hadn’t listened to me, and he said, “That’s fine, Judge. I had a client indicate to me that his charges should be dropped because the officer has not read him his Miranda rights. I asked my client what happened. He indicated that he was sitting on his front porch when the police pulled up. They got out of their cruiser and walked over to talk to him.
